We cannot accept orders by individuals located outside the United Kingdom, and by equal measure, we cannot deliver to addresses outside the United Kingdom.

All media & content provided by this website is in (UK) English only, and translations are limited. All communication with you will be in (UK) English only (en-GB).

General

By placing an order through our castle-shutters.co.uk, you warrant that you are:

  • "Standard Product" in the context of the product means;

    • Item'/s to be supplied by us as noted in the order.

The structure of use & contract between you and us

Note any choices selected by you the user can be changed at any time up until you place your order with us by clicking on the "Purchase" option during the checkout process.

If a product or service is out of stock or unavailable, an alert will be displayed on the subsequent page when browsing.

We will indicate when the information requested is necessary so that we can process your order. We will also ask you to choose how we can use your data and then validate your identification data and your choice through e-mail.

Delivery

Unless otherwise expressly agreed in writing, any delivery or supply date or time specified by us in any Order or otherwise is a best estimate only.

We will not be liable to you for any loss or damage sustained by you if we fail to meet that time scale because of circumstances beyond our reasonable control.

Some UK postcode areas may be subject to longer delivery times, and depending on the products you order, delivery charges to the UK mainland may vary:

  • Standard shipping fee applies unless otherwise stated – £6.50

To ensure we can reliably deliver your products/services, please include as much of your delivery address as possible. E.g., A flat number or company name, if appropriate and double-check your details to be on the safe side.

If you require an alternate invoicing address from your delivery address, please specify this in your account settings or during checkout.

Only one delivery address will be accepted per order, and products/services may be supplied in separate deliveries.

The estimated delivery time to complete the order will depend on the product/service selected and is just an estimate.

Payment and order description

Information regarding your order will appear at multiple stages on the site and relevant e-mails. This information indicates;

  • Which products you have ordered

  • Product price (Inc. VAT)

  • Delivery charges (If applicable)

  • Special refunds/discounts (If applicable)

  • Total net price

  • Invoice

  • Specified delivery address

At this point, only (GBP) pound sterling is accepted during checkout though we do offer multiple payment vendors.

After placing an order, you will receive an e-mail from us acknowledging that we have received your order and payment (the Order Acknowledgment of Receipt).

Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us.

We will send you an e-mail to confirm that the product has been dispatched (the Dispatch Confirmation) together with the invoice for that order.

The contract will relate only to those products/services we have accepted an order.

Security means used concerning your payment online

Our site utilises a payment system regulated and initialised by a dedicated third party, Stripe. A combination of both established and innovative techniques are employed by Stripe to ensure the security and integrity of all sensitive data.

The transfer of purchase details from castle-shutters.co.uk to Stripe is encapsulated using an encrypted and digitally-signed protocol, using a combination of standard methods such as PGP, RSA and MD5 to ensure that the information passed is secure and tamper-proof via SSL.

Any communication between the consumer and Stripe through the Castle Shutters domain is also encrypted to the maximum strength supported by the consumer's browser.

Consumers are also protected from their card's fraudulent use in a "card not present" environment by their card issuers.

The card issuers provide the right for a consumer to dispute a transaction if the goods/services did not arrive or if the card was used fraudulently. To learn more about this, contact your card issuer.

Customer rights

If you are contracting as a consumer, you may cancel a Contract at any time up to the fourteenth day after you received the product/service. In this case, you will receive a full refund of the price paid for the product/service per our Refund Policy. (Completed Services will be deducted from the refund amount total.)

To cancel a Contract, you must inform us in writing. You must also return the product('s) to us immediately (minus any completed services), in the same condition you received them, and at your own cost and risk.

You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

Availability and delivery

Your order will be fulfilled as indicated within a maximum of 30 days of receipt of your order, unless there are exceptional circumstances, or we agree otherwise between us.

Any delivery date indicated on the website, including in the Order Acceptance, are merely estimates and are not binding on us.

Risk and title

The Products will be at your risk from the time of delivery.

Ownership of the Products will pass to you only once the Products have been delivered and we have received full payment of all sums due in respect of the Products, including delivery charges.

Price and payment

Products/services will be as quoted on our site, except in cases of obvious error. We are under no obligation to provide a product/service to you in the event of obvious error.

Item's at the incorrect/lower price are subject to change, even after we have sent you a Dispatch Confirmation. General pricing is subject to change at any time, but changes will not affect orders we have expressly accepted in an Order Acceptance.

Prices, where indicated, include (VAT) but exclude delivery costs, possible refunds, or any other applicable taxes, which will be added to or deducted from the total amount due as set out in the summary of your order indicated before payment processing.

Payment for all Products must be by credit card, debit card. We accept Visa or Master card credit/debit card options. Your credit card/debit card will be charged at the time that you complete your payment.

Product liability

We warrant you that any product/service purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes we advise at the sale time.

Castle Shutters Ltd declines all liability for the consequences of installation (unless the installation service has been booked and provided by one of our engineers)

And further declines all liability for use or maintenance of the product which does not comply with the product characteristics, instructions provided, or the standards in force: you shall determine the suitability of the product for its intended use, with reference to usual standards, completed by the information we provide to you.

We are not responsible for losses that happen as a side effect of the direct loss or damage. Including but not limited to;

  • Loss of income or revenue,

  • Loss of business,

  • Loss of profits or contracts,

  • Loss of anticipated savings,

  • Loss of data,

  • Waste of management or office time

However arising, and whether caused by tort (including negligence), breach of contract or otherwise.

Nothing in this clause or elsewhere in these terms and conditions limits in any way our liability:

Subject to the exclusions above, our liability for losses you suffer because of us breaking this agreement is strictly limited to the purchase price of the product you purchased.

Written Communication

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website.

For contractual purposes, you agree to this electronic means of communication, and you acknowledge that all contracts, notices, information, and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

We may give notice to you at either the e-mail or postal address you provide to us when placing an order or in any of the ways specified in clause 14 above.

Notice will be deemed received and properly served when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.

In proving the service of any notice, it will be sufficient to prove that such letter was properly addressed, stamped, and placed in the post in the case of a letter.

In the case of an e-mail, such e-mail was sent to the addressee's specified e-mail address.

Transfer of rights and obligations

The contract between you and us is binding on you and us and our respective successors and assigns, as from our acceptance of your order by sending the Order Acceptance e-mail.

You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the contract term.

Events outside of our control

We will not be liable or responsible for any failure to perform, delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes

  • Lockouts or other industrial action

  • Civil commotion

  • Riot

  • Invasion

  • Terrorist attack or threat of terrorist attack

  • Fire, explosion

  • Storm

  • Flood

  • Earthquake

  • Subsidence

  • Epidemic or other natural disasters

  • Impossibility of the use of railways,

  • Shipping,

  • Aircraft,

  • Motor transport or other means of public or private transport.Impossibility of the use of public or private telecommunications networks.

  • The acts, decrees, legislation, regulations, or restrictions of any government.

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period.

We will use our reasonable endeavours to bring the Force Majeure Event to a close or find a solution by which our obligations under the contract may be performed despite the Force Majeure Event. 

Waiver

If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these terms and conditions shall be effective unless expressly stated to be a waiver and is communicated to you in writing per Notices.

Severability

If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful, or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Our rights to wary the terms and conditions

These terms and conditions and any document expressly referred to in them represent the entire agreement between us concerning any Contract's subject matter and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

We each acknowledge that, in entering a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us before such contract except as expressly stated in these terms and conditions.

Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, before the date of any Contract (unless such false information was provided fraudulently), and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.

Law and jurisdiction

We have the right to revise and amend these terms and conditions from time to time.

You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions unless you notify us to the contrary within seven working days of receipt by you of the Products).

This site, any exchange arising there-from and any Contracts for the purchase of Products through our site will be governed by English law.

Any dispute arising from or related to the use of this site or such Contracts shall be subject to the courts of England and Wales's exclusive jurisdiction.

Shipping & Delivery

Standard shipping is free on all orders. Within UK Mainland, we will endeavour to deliver orders placed before 12 pm, within five working days.

Should there be a reason that the product you ordered is not available, we will let you know within one working day from the moment you ordered.  

A tracking reference number is assigned to your order and sent to your contact e-mail address to track your order's progress.

Orders placed after 12 pm will be subject to a +24-hour time frame relative to the standard delivery information above.

Returns, Replacement & Cooling-off period

E-commerce regulations allow for a cooling-off period of 14 days from the date you purchased a product online.

During the 14-day cooling-off period, products returned to us will be refunded to you within 30 days after we received the product. Please be aware that products need to be in original condition and packaging preferably intact.

To return a product, please contact customer service via admin@castle-shutters.co.uk; they will guide you through the return process.

Warranty

Apart from the statutory warranty, * products purchased from castle-shutters.co.uk/shop have a 3-year warranty from the date of purchase.

* Legal guarantee means that you are entitled to a properly working product, i.e. what a product must do what a consumer can expect reasonably from.

Complaints

We aim to provide you with the best service possible.

However, If you need to file a complaint, please contact us by sending an e-mail to admin@castle-shutters.co.uk, and you will receive an answer within one working day.
